Court of Appeal of reverses Nyako's impeachment

A Court of Appeal in Yola, on Thursday, February 11, upturned the impeachment of Murtala Nyako as governor of Adamawa state.

The Adamawa State House of Assembly on July 15, 2014 had impeached Nyako after lawmakers adopted a report of a panel set up to investigate him of alleged misappropriation of state fund.

The report indicted the former governor guilty of all the 16 allegations of gross misconduct.
But the Court of Appeal ruled that the impeachment of Nyako as governor of the state in 2014 was not carried out within the provision of the law, Premium Times reports.
Justice Tunde Ayotoye, who delivered the lead judgment, said that Nyako was not given fair hearing in the impeachment proceedings.
The court explained that the ex-governor’s right was violated and declared all the process leading to the impeachment as null and void.

The judges ordered that the ex-governor be accorded all right of the office of governor of Adamawa state through the period in office and be paid all his entitlement as governor.
The court denied Nyako prayed to be returned as governor of the state.
The judges held that his tenure as governor had expired but chided the state House of Assembly and some politicians for setting up a panel to investigate Nyako despite a court retraining such move.
